Privacy Policy

This privacy policy explains which personal data we process when you visit thermonom.de, for what purpose, on what legal basis and for how long. You can use our website without providing any personal data.

Without your consent, we only set cookies that are strictly necessary for operating the website (Section 25(2) No. 2 of the German Telecommunications Digital Services Data Protection Act, TDDDG). Optional content, currently the videos in our media library (Section 5), is only loaded after you have given your consent (Section 25(1) TDDDG, Art. 6(1)(a) GDPR). We do not use web analytics on this website.

We manage your consent with the WordPress plugin Borlabs Cookie. It runs on our own web server; no data is transferred to the manufacturer. Borlabs Cookie sets the cookie “borlabs-cookie”, which stores your choice and a randomly generated pseudonymous identifier (UID). The cookie is valid for 60 days.

To document your consent, we log the UID, your choice, the version of the consent settings and the time in our database. No IP address is stored. These entries are automatically deleted after 30 days. The legal basis is Art. 6(1)(c) in conjunction with Art. 7(1) GDPR (obligation to demonstrate consent).

3. Hosting and server log files

Our website is hosted by MSISP. The server is located in a data centre in Germany. We have concluded a data processing agreement with the hosting provider in accordance with Art. 28 GDPR; the provider processes the data only on our instructions.

Each time our website is accessed, the server automatically stores the following data in log files: IP address of the accessing device, date and time of access, page or file requested, HTTP status code, amount of data transferred, the previously visited page (referrer) and browser and operating system (user agent).

We need this data to deliver the website, to ensure its security and stability, and to detect errors or attacks. The legal basis is Art. 6(1)(f) GDPR; our legitimate interest is the secure and trouble-free operation of the website. The log files are automatically deleted after [number] days.

4. Contact by form and email

If you contact us via the contact form or by email, we process the information you provide (such as name, company, email address, message and any further voluntary details) in order to answer your enquiry. Information from the contact form is delivered to us by email.

The legal basis is Art. 6(1)(b) GDPR if your enquiry relates to a contract or steps prior to entering into a contract, and otherwise Art. 6(1)(f) GDPR; our legitimate interest is answering enquiries about our products.

Our email mailbox is provided by Google Workspace (Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland). Google processes the data as a processor on the basis of an agreement pursuant to Art. 28 GDPR. A transfer to the USA cannot be ruled out; Google LLC is certified under the EU-US Data Privacy Framework (Art. 45 GDPR).

We delete your enquiry once it has been fully dealt with, unless statutory retention obligations apply. If the enquiry leads to a business transaction, the retention periods under commercial and tax law of up to 10 years apply.

5. Videos in the media library (YouTube)

In our media library we embed product videos from YouTube. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

Until you give your consent, you will see a placeholder instead of the video and no connection to YouTube is established. Only when you release the video or have consented to the “External Media” category does your browser load the video from YouTube. In particular, your IP address, the page visited and technical device information are transmitted to YouTube; YouTube may set cookies. If you are logged in to Google, YouTube may associate the visit with your account.

The legal basis is Art. 6(1)(a) GDPR and Section 25(1) TDDDG. A transfer to the USA is possible; Google LLC is certified under the EU-US Data Privacy Framework (Art. 45 GDPR). You can withdraw your consent at any time (Section 2).

6. Your rights

You have the following rights regarding your personal data at any time. To exercise them, please use the contact details given in Section 1.

Right to object (Art. 21 GDPR): Where we process your data on the basis of Art. 6(1)(f) GDPR, you may object at any time on grounds relating to your particular situation. We will then no longer process the data unless we demonstrate compelling legitimate grounds or the processing serves the establishment, exercise or defence of legal claims.

Right to lodge a complaint (Art. 77 GDPR): You may lodge a complaint with a data protection supervisory authority. The authority responsible for us is:

No automated decision-making, including profiling (Art. 22 GDPR), takes place. We store personal data only for as long as necessary for the respective purpose or as required by statutory retention periods; the specific periods are set out in Sections 2 to 5.
